1. Agreement to Terms
By accessing or using any products or services provided by Virix Labs ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
These Terms apply to all of our products and services, including:
- Cherriva — AI companion chatbot
- TunedForYou — AI-powered personalized songs
- InkOn — AI tattoo visualization
- VacateNotice — Legal document generator
- Human Browser — AI browser automation infrastructure for AI agents
- Clawster — Hosted OpenClaw AI agent with no-server setup and private containers
Together with any associated websites, mobile applications, and related services (collectively, the "Services").
2. Eligibility
You must be at least 16 years of age to use our Services. Cherriva requires users to be at least 18 years of age. By using our Services, you represent that you meet the applicable age requirement.
3. Account Registration
Some of our Services require you to create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Accept responsibility for all activity under your account
Each person may maintain only one account per Service. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Products and Services
- Cherriva: An AI-powered companion chatbot that enables conversational interactions with AI-generated characters. Available via web and Telegram.
- TunedForYou: A platform that creates AI-generated personalized songs as gifts, based on user-provided details about the recipient.
- InkOn: An AI-powered tool for visualizing tattoo designs on your body using uploaded photos.
- VacateNotice: A document generation tool that creates notice-to-vacate letters customized for specific US states.
- Human Browser: A browser automation product built for AI agents, including residential IP, anti-bot handling, and OpenClaw integration.
- Clawster: A hosted OpenClaw AI agent service that runs private containers 24/7 with Telegram/WhatsApp workflows, built-in Human Browser, and minimal user configuration.
5. Payments, Subscriptions, and Credits
5.1 General
All payments are processed securely through Stripe. Prices are displayed in USD unless otherwise indicated. By making a purchase, you agree to Stripe's Terms of Service.
5.2 Cherriva Subscriptions
Cherriva offers the following subscription plans:
- Weekly: $9.99/week
- Monthly: $18.99/month
- Annual: $69.99/year
Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You will be charged the applicable subscription fee at the beginning of each billing period. Credits are allocated at the start of each billing cycle according to your plan.
5.3 Cherriva Credit Packs
Additional credit packs are available for one-time purchase:
- $0.99 credit pack
- $3.99 credit pack
- $9.99 credit pack
Credit packs are non-refundable once credits have been used.
5.4 TunedForYou
TunedForYou offers one-time purchases:
- Standard song: $9
- Premium song: $19
5.5 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at general@virixlabs.com. Cancellation takes effect at the end of your current billing period. You will continue to have access to your subscription benefits until the end of the paid period. No partial refunds are provided for unused time within a billing cycle.
5.6 Refund Policy
Due to the digital nature of our products, purchases are generally non-refundable once the product has been delivered or credits have been used. We may issue refunds at our discretion in the following cases:
- Technical failure preventing delivery of the purchased product
- Duplicate charges for the same purchase
- Unauthorized transactions (with verification)
Refund requests must be submitted within 14 days of purchase to general@virixlabs.com. Approved refunds are processed within 5–10 business days.
6. AI-Generated Content
Our Services use artificial intelligence to generate content including text, music, images, and documents. You acknowledge and agree that:
- AI-generated content is provided "as is" without guarantees of accuracy, quality, or fitness for any particular purpose.
- VacateNotice generates documents for informational purposes only and does not constitute legal advice. You should consult a qualified attorney for legal matters.
- Cherriva characters are entirely fictional. Conversations with AI characters should not be considered personal, professional, or medical advice.
- We do not guarantee the availability, consistency, or quality of AI-generated outputs. Results may vary.
7. User Content and Conduct
You are responsible for all content you submit through our Services. You agree not to use our Services to:
- Create, upload, or distribute content involving minors in any harmful, exploitative, or inappropriate context
- Harass, threaten, or abuse other users
- Impersonate any person or entity
- Upload or transmit malware, viruses, or other harmful code
- Scrape, crawl, or use automated means to access our Services without authorization
- Circumvent payment systems or exploit free tiers
- Violate any applicable law or regulation
We reserve the right to remove content and suspend accounts that violate these rules without notice.
8. Intellectual Property
All intellectual property in our Services — including software, designs, branding, and AI models — is owned by Virix Labs or its licensors.
We grant you a limited, non-exclusive, non-transferable, revocable license to use our Services for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, distribute, or create derivative works from our Services.
9. DMCA and Copyright
We respect intellectual property rights. If you believe content on our Services infringes your copyright, please send a takedown notice to general@virixlabs.com including:
- Identification of the copyrighted work claimed to be infringed
- Identification of the material that is claimed to be infringing and its location on our Services
- Your contact information
- A statement that you have a good faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
Counter-notifications may be submitted following the same process. We will respond to valid notices in accordance with applicable copyright law.
10. Disclaimers and Limitation of Liability
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIRIX LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) EUR 100.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law, including UK and EU consumer protection laws.
11. Indemnification
You agree to indemnify and hold harmless Virix Labs, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit through our Services
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer based in the EU or EEA, you retain any mandatory consumer protection rights under the laws of your country of residence. You may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
13. Termination
You may stop using our Services and delete your account at any time. We may suspend or terminate your access to the Services at our discretion, without prior notice, if we believe you have violated these Terms or applicable law.
Upon termination, the following sections survive: Intellectual Property, Disclaimers and Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.
14. Modifications
We may modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our Services. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
15. General Provisions
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Virix Labs.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.
- No waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
- Assignment: We may assign our rights and obligations under these Terms. You may not assign yours without our written consent.
- Force majeure: We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control.
